Article 309 के तहत संघ या राज्य की सेवा करने वाले व्यक्तियों की भर्ती और सेवा की शर्तों का वर्णन है।

अनुच्छेद 309 के तहत कहा गया है कि इस संविधान के उपबंधों के अधीन रहते हुए, समुचित विधान-मंडल के अधिनियम संघ या किसी राज्य के कार्यकलाप से संबंधित लोक सेवाओं और पदों के लिए भर्ती का और नियुक्त व्यक्तियों की सेवा की शर्तों का विनियमन कर सकेंगे;

इस संविधान के प्रावधानों के अधीन, उपयुक्त विधानमंडल के अधिनियम संघ या किसी राज्य के मामलों के संबंध में सार्वजनिक सेवाओं और पदों पर भर्ती और नियुक्त व्यक्तियों की सेवा की शर्तों को विनियमित कर सकते हैं:

परंतु जब तक इस अनुच्छेद के अधीन समुचित विधान-मंडल के अधिनियम द्वारा या उसके अधीन इस निमित्त उपबंध नहीं किया जाता है तब तक, यथास्थिति,

संघ के कार्यकलाप से संबंधित सेवाओं और पदों की दशा में, राष्ट्रपति या ऐसा व्यक्ति जिसे वह निदिष्ट करे; और,

राज्य के कार्यकलाप से संबंधित सेवाओं और पदों की दशा में, राज्य का राज्यपाल या ऐसा व्यक्ति जिसे वह निदिष्ट करे,

ऐसी सेवाओं और पदों के लिए भर्ती का और नियुक्त व्यक्तियों की सेवा की शर्तों का विनियमन करने वाले नियम बनाने के लिए सक्षम होगा और इस प्रकार बनाए गए नियम किसी ऐसे अधिनियम के उपबंधों के अधीन रहते हुए प्रभावी होंगे।

कहने का अर्थ है कि अनुच्छेद 309 में खंड उन लोगों के लिए भर्ती और कर्तव्य की शर्तों को दर्शाता है जो संघ या किसी राज्य के व्यवसाय के संबंध में संघ या राज्य सार्वजनिक सेवा और कार्यालयों में सेवा करेंगे।

सार्वजनिक सेवाओं और पदों पर भर्ती और इसमें नियुक्त लोगों की सेवा की शर्तों को इस संविधान की आवश्यकताओं के अधीन, संबंधित विधानमंडल के अधिनियमों द्वारा विनियमित किया जा सकता है।

अनुच्छेद 309 द्वारा प्रदत शक्ति इस अनुच्छेद के प्रारंभिक शब्दों के अध्यधीन है। ये शब्द न केवल विधान मंडल की शक्ति को शासित करते हैं बल्कि परंतुक द्वारा प्रदत नियम बनाने की शक्ति को भी। अतएव यदि कोई नियम संविधान के किसी उपबंध का उल्लंघन करता है, जैसे अनुच्छेद 14, 15, 16, 19, 229, 234, 310(1) या 311(2) का, तो वह नियम शून्य होगा।

आपको याद होना चाहिए कि संविधान में यह उपबंध है कि संघ और राज्य के क्रियाकलाप से संबन्धित कुछ अधिकारी किस प्रकार नियुक्त किए जाएंगे और उनकी सेवा की शर्तें क्या होगी।

उदाहरण के लिए महान्यायवादी [अनुच्छेद 76] को लिया जा सकता है। इसी प्रकार संविधान में कुछ अन्य उपबंध है जिनके द्वारा लोक सेवकों के कुछ वर्ग की सेवाओं के संबंध में नियम बनाने की शक्ति कुछ अन्य प्राधिकारियों को दी गई है जैसे अनुच्छेद 98 और अनुच्छेद 187 [संसद के दोनों सदनों और राज्य विधान मंडल के कर्मचारियों के संबंध में], अनुच्छेद 146(2) [उच्चतम न्यायालय के संबंध में], अनुच्छेद 148(5) [भारतीय संपरीक्षा और लेखा विभाग में काम करने वाले व्यक्ति], अनुच्छेद 229(2) [उच्च न्यायालय के अधिकारी]। इसीलिए याद रखिए कि अनुच्छेद 309 इन वर्गों के सरकारी सेवकों को लागू नहीं होगा।
